§ 10-82. Classifications of licenses.

  • The City of East St. Louis, Illinois hereby establishes the following classifications of liquor licenses:

    (1)

    1AA—Tavern license. A Class 1AA Tavem License shall entitle the licensee to sell alcoholic liquor for consumption on the licensed premises during the hours prescribed in section 10-83 below.

    (2)

    1AF—Package liquor and bar/tavern. A Class 1AF Package Liquor and Bar/Tavern License shall entitle the licensee to sell alcoholic liquor on the licensed premises during the hours prescribed in section 10-83 below. Said licenses shall permit the licensee to sell alcoholic liquor (a) in its original package for consumption off the licensed premises, and (b) by the drink for consumption on the licensed premises. The sale of alcoholic liquor by the licensee for consumption on the licensed premises shall be restricted to a specific room or area on the premises. This area shall be sufficiently separated from the remainder of the premises by walls or other physical barriers such that admission to said area by minors may be effectively restricted.

    (3)

    1BB—Private Club License. A Class 1BB Private Club License shall entitle the licensee to sell alcoholic liquor for consumption on the licensed premises during the hours prescribed in section 10-83 below. In addition to any other requirement prescribed herein, a private club license shall only be issued to a regularly organized private club which shall serve alcoholic liquor to members and members' guests only. Any applicant under this classification must file with the local liquor control commissioner at the time of its application for a license a list of names and residences of its members. Further, any licensee under this classification must file within ten days of the election of any additional member his or her name and address.

    (4)

    1CC—15-day license. A Class 1CC 15 Day License shall entitle the licensee to sell only beer and wine for consumption on the licensed premises, for a period not to exceed 15 days, during the hours prescribed in section 10-83 below. Such a license shall not be issued to any person holding a tavern, nightclub, bowling alley, or private club license; nor shall such licensee be issued any other license for 60 days after the expiration of a 15-day license.

    (5)

    1DD—One-day license. A Class 1DD One Day License shall entitle the licensee to sell only beer and wine for consumption on the licensed premises, for a period not to exceed one day, during the hours prescribed in section 10-83 below. Such a license shall not be issued to any person holding a tavern, nightclub, bowling alley, or private club license; nor shall such licensee be issued any other license for 60 days after the expiration of the one-day license.

    (6)

    1E—Service/filling station license. A Class 1E Service/Filling Station License shall entitle the licensee to sell only beer and wine in its original package for consumption off the licensed premises during the hours prescribed in section 10-83 below. All licenses of this classification are further subject to the following requirements:

    a.

    Licensees in this category shall maintain with the local liquor control commissioner a current and accurate list of all persons acting as managers.

    b.

    Licensees in this category shall not allow consumption of beer or wine on the licensed premises nor shall they allow the display of beer or wine on islands, curbings, or in storefronts other than inside the enclosed structure of the principal housing of that business.

    c.

    Licensees in this category shall not allow beer or wine to be delivered, dropped off, picked up, or in any other way dispensed directly to persons maintaining their presence in or on a motor vehicle.

    (7)

    1FF—Package liquor only license. A Class 1FF Package Liquor Only License shall entitle the licensee to sell alcoholic liquor, in its original package only, or jug beer in a suitable, sealed container for transportation from the licensed premises, for consumption off the licensed premises, but shall not authorize consumption on the licensed premises. Said sales may only be made during the hours prescribed in section 10-83 below.

    (8)

    1GB—Casino license. A Class 1GB Casino License shall entitle the licensee to sell alcoholic liquor for consumption on the licensed premises during the hours prescribed in section 10-83 below.

    (9)

    1GG—Golf Course License. A Class 1GG Golf Course License shall entitle the licensee to sell alcoholic liquor for consumption on the licensed premises during the hours prescribed in section 10-83 below.

    (10)

    1K—Caterer license. A Class 1K Caterer License shall entitle the licensee to sell alcoholic liquor for consumption on the licensed premises during the hours prescribed in section 10-83 below. Said license must be issued for a particular event. Each event shall not exceed 15 total days. Persons seeking a caterer license must file a separate application for each event at least seven working days prior to the beginning of said event with the local liquor control commissioner. Such a license shall not be issued to any person holding a tavern, nightclub, bowling alley or private club license. The caterer license shall be posted in a conspicuous place on the licensed premises where the event will be held.

    (11)

    1PC—Private club—Public access license. A Class 1PC Private Club—Public Access License shall entitle the licensee to sell alcoholic liquor for consumption on the licensed premises during the hours prescribed in section 10-83 below. In addition to any other requirement prescribed herein, a private club—public access license shall only be issued to a regularly organized private club which shall serve alcoholic liquor to members and members' guests only. A private club—public access license shall also entitle the licensee to schedule gatherings and promote to the general public for the purpose of recruitment and charitable promotion. Nonmembers, other than members' guests, shall be allowed upon the premises for the purpose of recruitment and charitable promotion only.

    (12)

    1RR—Outdoor recreational center license. A Class 1RR Outdoor Recreational Center License shall entitle the licensee to sell only beer and wine for consumption on the licensed premises during the hours prescribed in section 10-83 below.

    (13)

    1WW—Beer and wine only license. A Class 1WW Beer and Wine Only License shall entitle the licensee to sell only beer and wine (a) in its original package for consumption off the licensed premises, and (b) by the drink for consumption on the licensed premises, during the hours prescribed in section 10-83 below.

    (14)

    2AA—Bowling alley license. A Class 2AA Bowling Alley License shall entitle the licensee to sell alcoholic liquor for consumption on the licensed premises during the hours prescribed in section 10-83 below.

    (15)

    3AA—Nightclub license. A Class 3AA Nightclub License shall entitle the licensee to sell alcoholic liquor for consumption on the licensed premises during the hours prescribed in section 10-83 below. In addition to any other requirement prescribed herein, the holder of a nightclub license shall provide, not less than six nights a week, food service and musical entertainment and dancing space for patrons.

    (16)

    4AA—Restaurant license. A Class 4AA Restaurant License shall entitle the licensee to sell only beer and wine for consumption on the premises during the hours prescribed in section 10-83 below.

    The classification of license granted to an eligible applicant shall be determined by the type and nature of the business or activity generally taking place upon or near the premises upon which the license is sought. Said determination shall be made in the sole discretion of the local liquor control commissioner.
