§ 118-261. Presumption of on duty.

  • (a)

    A taxicab driver shall be presumed to be on duty if he is on record as being on duty at the office of the certificate holder by whom he is employed, or if he has custody of a taxicab which is parked at a taxicab stand or other place, public or private, in anticipation of patronage or in furtherance of procurement of patronage.

    (b)

    Any taxicab or service car which is being operated or is parked or stopped upon any public street, alley or other public place shall be presumed to be on duty if the taxicab or service car does not display in the front window of such taxicab or service, so to be easily discernible, a placard or sign containing the words "Not for Hire," which words shall be in characters at least three inches in height.
