§ 66-131. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    African American means a person having origins in any of the black racial groups of Africa, and not of Hispanic origin.

    American Indian and Alaskan native mean a person having origins in any of the original peoples of North America.

    Asian means a person having origins in any of the original peoples of the Far East, Southeast Asia, the Indian subcontinent or the Pacific Islands.

    Bid means a quotation, proposal or offer by a bidder or contractor to perform or provide labor materials, supplies or services to the city for a price.

    Bidder means any person, partnership, corporation or other business that submits a bid to the city.

    Certified MBE (minority business enterprise) or FBE (female business enterprise) means a MBE or FBE that meets the requirements of this division and has been approved by the contract compliance committee.

    Contract means any agreement entered or awarded by the city or the Casino Queen for employment or work, labor, services, supplies, equipment or materials, or any combination thereof, within the city.

    Contractor means any bidder awarded or seeking award of a city contract, including every subcontractor under such contract.

    Eligible project means any city or Casino Queen construction project.

    Female business enterprise (FBE) means a business which is an independent and continuing enterprise for profit, which performs a commercially useful function and is owned by one or more females and certified as such by the contract compliance committee.

    Hispanic means a person of Spanish or Portuguese culture, with origins in Mexico, South America, Central America or the Caribbean Islands, regardless of race.

    Minority business enterprise (MBE) means a business which is an independent and continuing enterprise for profit, which performs a commercially useful function and is owned by one or more minority group members, which groups have been determined by the contract compliance committee as having suffered discrimination requiring amelioration and certified as such by the contract compliance committee.

    Owned means, for purposes of determining whether a business is a MBE or FBE, that the minority or female owners shall possess an ownership interest of at least 51 percent of the business. Such ownership shall be real and continuing and shall go beyond the mere indicia of ownership as may be reflected in ownership documents. Further, the minority or female owners shall share in the risks and profits commensurate with their ownership interest.
